TERMS OF USE & PRIVACY POLICY

Lumina Visual Arts Academy

Terms of Use & Privacy Policy

Effective Date: October 11, 2026
This document contains both the Terms of Use and Privacy Policy for Lumina Visual Arts Academy. Please read both parts carefully.

Part I — Terms of Use

By accessing or using the Lumina Visual Arts Academy website, courses, memberships, or related services (collectively, the “Services”), you agree to these Terms of Use and the Privacy Policy included in this document. If you do not agree to these Terms, do not use the Services.

These Terms apply to visitors and customers who use Lumina’s Services. The educational materials made available through the Services are protected by copyright, trademark, and other applicable laws.

1. Intellectual Property

Unless otherwise indicated, the courses, videos, lessons, demonstrations, graphics, text, logos, and other educational materials provided by Lumina Visual Arts Academy (“Lumina”) are owned by Lumina or licensed to Lumina and are protected by intellectual property laws.

Your access to Lumina’s educational materials is for your personal, non-commercial learning. Except where a course or resource expressly permits otherwise, you may not copy, reproduce, redistribute, resell, publicly display, publish, modify, or commercially exploit Lumina’s materials without prior written permission from the relevant rights holder.

Nothing in this section transfers ownership of your own artwork or other original content to Lumina. Your artwork remains yours, subject to any rights you separately grant when using a service or third-party platform.

2. Permitted Use of Course Materials

You may access and use course materials for your own personal educational purposes while you are entitled to access the relevant course, product, or membership. You may download resources that Lumina makes available for download, subject to the terms presented with those resources.

You may not:

Resell, share, redistribute, or publicly post Lumina’s course materials without authorization.
Use course materials to create or sell a competing product or training program without written permission.
Remove copyright, trademark, or other proprietary notices.
Attempt to reverse engineer software provided through the Services, where prohibited by law.
Circumvent access controls or share account credentials to provide unauthorized access to paid content.

Access to materials may end when the applicable course access period or membership ends, as described at the time of purchase. These restrictions do not limit any rights that cannot lawfully be restricted.

3. Your Artwork and Other Submissions

You retain ownership of artwork and other original content you create. If you submit artwork directly to Lumina for educational feedback or another requested service, you authorize Lumina to host, store, display, and process that submission only as reasonably necessary to provide the requested service, maintain its security, and meet legal obligations.

Lumina Visual Arts Academy will not use your artwork to train, fine-tune, or improve generative AI models.

You are responsible for ensuring that you have the necessary rights to submit any material you provide. Please do not submit content that infringes another person’s rights or contains information you are not authorized to share.

If you choose to post artwork or other content on an external community platform, such as Discord, that platform’s own terms and privacy practices also apply. Other members may be able to view, copy, or share content you post there. Review the platform’s settings and terms before sharing.

4. User Conduct

You agree to use the Services lawfully and respectfully. You may not:

Interfere with, damage, disable, or impair the Services or another person’s use of them.
Harass, threaten, abuse, or unlawfully discriminate against other users or Lumina staff.
Upload or transmit malware or other harmful code.
Use the Services to infringe intellectual property, violate privacy, or engage in unlawful activity.
Attempt to gain unauthorized access to accounts, systems, or paid content.

Lumina may remove content, restrict access, or suspend or terminate an account where reasonably necessary to address a violation of these Terms, protect users or the Services, or comply with law.

5. Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials and for activities conducted through your account. Notify Lumina promptly if you believe your account has been accessed without authorization.

You must provide accurate account information and keep it reasonably up to date. Lumina may suspend access when necessary to protect account security or address suspected misuse.

6. Privacy and Data Protection

The Privacy Policy in Part II of this document explains what information we collect, how we use it, and the choices available to you.

Lumina does not sell your personal information. Lumina will not use artwork submitted directly to Lumina to train, fine-tune, or improve generative AI models. Third-party services you use in connection with Lumina may handle information under their own applicable terms and privacy policies.

7. Payments, Subscriptions, Cancellations, and Refunds

Prices are stated in U.S. dollars unless otherwise indicated. Payment is due at the time of purchase, or according to the payment schedule disclosed at checkout. Applicable taxes may be added where required.

Subscriptions

A subscription renews automatically at the interval disclosed at checkout until canceled. You may cancel a subscription using the available account controls or by contacting the relevant service provider. Unless the offer states otherwise, cancellation prevents future renewals and access continues through the end of the paid billing period. Cancellation does not ordinarily result in a refund for a partially used billing period, except where required by law or stated in the applicable offer.

Installment payment plans

An installment plan for a course or product is different from a recurring subscription. If you select an installment plan, you agree to pay the installments disclosed at checkout. Canceling a separate membership or subscription does not cancel an installment-payment obligation for a purchase, unless the applicable offer or law says otherwise.

Refunds

Unless a product page or separate written policy states otherwise, purchases are non-refundable except where a refund, cancellation, or withdrawal right is required by applicable law. Nothing in these Terms excludes or limits any consumer right that cannot lawfully be excluded or limited.

Product-specific access, cancellation, and refund terms shown at checkout form part of the offer for that product. Please review them before purchasing.

8. Third-Party Services and Links

Lumina may use or link to third-party services, including platforms for course delivery, payment processing, email communications, and community participation. These services are operated by their respective providers and may be subject to separate terms and privacy policies. Lumina is not responsible for the independent terms or practices of third-party services, except as required by applicable law.

9. Limitation of Liability

To the extent permitted by applicable law, Lumina will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, business, or data arising from your use of, or inability to use, the Services.

The Services and educational materials are provided for learning purposes. We do not guarantee any particular artistic, educational, professional, or financial result.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, or affects rights that applicable law makes non-waivable.

10. Governing Law and Disputes

These Terms are governed by applicable law, subject to any mandatory consumer protection laws that apply to you. Any dispute will be handled by a court or other body with jurisdiction under applicable law. Nothing in this section limits rights or remedies that cannot lawfully be waived.

11. Force Majeure

Lumina is not responsible for delay or failure to perform caused by events beyond its reasonable control, such as natural disasters, widespread service interruptions, government action, or other unforeseen events. This section does not limit rights that cannot lawfully be restricted.

12. Age Requirements

The Services are not intended for children under 13, and children under 13 may not use or access them. If applicable law requires a higher minimum age or additional consent, those requirements apply.

13. Accessibility

Lumina is committed to improving the accessibility and usability of its Services for a broad range of users and to meeting accessibility requirements that apply to it.

14. Changes to These Terms

We may update these Terms when our Services, practices, or legal obligations change. We will post the updated Terms with a revised effective date and provide additional notice of material changes where appropriate. Continued use of the Services after updated Terms take effect constitutes acceptance to the extent permitted by law.

We use reasonable technical and organizational safeguards to protect personal information against unauthorized access, loss, or misuse.
Access to information is limited to what is reasonably necessary to operate and support our services. No online service can guarantee absolute security, but we are committed to handling information responsibly.

Email and website service providers: Newsletter delivery, communications, and technical operations, as applicable.

These providers may process information necessary to provide their services and may also handle information under their own applicable terms and privacy policies. When you use an external service directly, its own policies apply to its processing of your information.

8. Children's Privacy

The Services are not intended for children under 13, and children under 13 may not use or access them. If applicable law requires a higher minimum age or additional consent, those requirements apply. If you believe a child has provided personal information inappropriately, please contact us.
